These Terms and Conditions ("Terms") govern your use of invictusexterior.com (the "Site") and any services contracted through Invictus Exterior Construction ("we", "us"). By using the Site or engaging us for services, you agree to these Terms.
1. Free Inspections and Estimates
Inspections are provided at no cost and with no obligation. Estimates remain valid for 30 days from issuance unless stated otherwise in writing. Material pricing may change due to supplier cost changes outside of our control.
2. Contracts and Payment
All work is performed under a written agreement signed by both parties. Payment terms, scope, materials, and warranty are documented in that agreement. Texas Property Code Chapter 53 lien rights apply to contracted work.
3. Insurance Claim Assistance
When you ask us to assist with a property insurance claim, we document damage, prepare a scope estimate, and meet your adjuster on site. We do not act as a public adjuster, do not negotiate the claim on your behalf, and do not require you to use us if your claim is approved. Texas law gives you the right to cancel any contract contingent on insurance approval within five days of receiving notice that all or part of the claim has been denied. 4. Warranties
Workmanship is warrantied for the life of the installation by Invictus Exterior Construction. Material warranties are provided by the product manufacturer. Specific warranty terms are delivered with your project paperwork. Warranties do not cover damage from acts of God, third-party modifications, or lack of reasonable maintenance.
5. Site Content
Project photos, copy, logos, and design on this Site are the property of Invictus Exterior Construction. You may share links to public pages with attribution. You may not republish substantial content without written permission.
6. Third-Party Links
We link to third-party sites such as manufacturers, the Texas Department of Insurance, and industry associations. We are not responsible for the content or practices of those sites.
7. Disclaimers
Site content is provided "as is" for general information. Specific recommendations require an on-site inspection. We make no warranty that the Site will be error-free or uninterrupted.
8. Limitation of Liability
To the fullest extent permitted by law, our liability arising from use of the Site is limited to the amount you paid (if any) to access it, which is typically zero. Liability arising from contracted services is governed by the signed project agreement.
9. Governing Law
These Terms are governed by the laws of the State of Texas. Any dispute is subject to the exclusive jurisdiction of the state and federal courts located in Harris County, Texas.
